Terms of Service

Aajar Attendance App · Last updated

These terms are the agreement between Score Xcreen and the organization that signs up for the Aajar Attendance App. Please read them before you create an organization. If you do not agree, do not use Aajar.

1. Who we are and what these terms cover

Aajar Attendance App (“Aajar”, the “Service”) is an online service for employee attendance, leave, payroll and related HR work, provided at aajar.scorexcreen.com by Score Xcreen (“Score Xcreen”, “we”, “us”, “our”). These Terms of Service (the “Terms”) apply to every organization that creates an account (the “Customer”, “you”) and to every person the Customer adds or invites (a “User”).

The following documents are part of these Terms: the Privacy Policy, the Refund and Cancellation Policy, the Data Processing Addendum and the Acceptable Use Policy. If they conflict, the Data Processing Addendum prevails on how personal data is handled, and these Terms prevail on everything else.

2. Business use and eligibility

Aajar is a business service. The person who creates the organization confirms that they are at least 18 years old, are authorised to bind the organization to these Terms, and will become its Owner. By creating an organization, or by accepting an invitation to join one, you accept these Terms. This is an electronic contract under the Information Technology Act, 2000, and needs no signature.

3. Accounts, roles and security

  • The Owner and the Admins the Customer appoints control the organization: who is invited, which role each person has (Owner, Admin, HR or Employee), and what they can see and do.
  • The Customer is responsible for everything done through its users' logins, for keeping passwords private, and for removing access when someone leaves.
  • Give us accurate information when you sign up and keep it up to date. We may send service and billing emails to the address on the account.
  • Tell us promptly through the Help & contact form if you think a login has been misused.

4. The Service and plans

Aajar is offered in plans (currently Starter, Growth and Business). The features each plan includes are listed on the Pricing page and are switched on in the app for the plan you chose. We may improve, change or retire features. If a change removes a feature from the plan you are paying for, we will tell you in advance and, if it materially affects you, you may cancel under the Refund and Cancellation Policy.

5. Free period

A new organization gets the plan it chooses at signup free of charge: for 3 months if the organization has up to 50 users, and for 1.5 months (45 days) if it has more than 50 users. The count is the larger of the team size given at signup and the highest number of people the organization has had during the free period. If the organization grows past 50 users during the free period, the free period becomes 45 days from its start, but never ends sooner than 7 days after the growth is recorded. No card is needed for the free period. When it ends, the Customer is asked to pay for the plan it originally chose, or to choose another plan, to keep using Aajar. We may change the free-period terms for new signups at any time; a change does not shorten a free period that has already begun.

6. Fees, taxes and payment

  • Paid plans are charged per user per month at the prices on the Pricing page when you place the order, in Indian rupees. Prices exclude GST and other applicable taxes, which are added on the invoice.
  • You choose the number of users and a billing period (monthly, every three months or yearly; longer periods may carry a discount shown at checkout). We issue a tax invoice and a payment link for each order.
  • You can pay online through the payment methods shown on the invoice, or by bank transfer or UPI and then submit the payment details for confirmation. We do not store card or bank-account numbers; payments are handled by our payment partners.
  • Aajar does not automatically debit your card or bank account. A renewal is a new invoice that you choose to pay.
  • If the number of people in your organization is higher than the users you have paid for, we may ask you to pay for the additional users.
  • If a plan ends and is not renewed, you have a short grace period (shown in the app, currently 7 days by default). After that the dashboard is paused until payment. Pausing does not delete your data; see section 12.
  • Refunds are governed by the Refund and Cancellation Policy.

7. Your data and your responsibilities

The Customer owns the data it and its users put into Aajar (“Customer Data”), including attendance, leave, salary and employee records. You give us a limited licence to host, process, back up and display Customer Data only as needed to run and support the Service for you. For personal data in Customer Data, the Customer decides why and how it is used and we process it on the Customer's behalf as described in the Data Processing Addendum.

The Customer is responsible for:

  • having a lawful basis, and giving employees any notice or obtaining any consent that the law requires, before it records their attendance, location, biometric punches or salary details in Aajar;
  • the accuracy of the data entered, the leave and attendance rules it configures, and every payroll figure it approves or publishes;
  • complying with the labour, wage, provident fund, ESI, professional tax, income tax and other laws that apply to it as an employer. Aajar helps you record and calculate; it does not give legal, tax or accounting advice, and you should have payslips and statutory filings checked by a qualified professional.

8. Acceptable use

You and your users must follow the Acceptable Use Policy. In short: use Aajar only for lawful workforce management, do not attack or overload it, do not try to reach another organization's data, and do not use it to secretly monitor people.

9. Our rights in the Service

Aajar, its software, design, text and trademarks belong to Score Xcreen or its licensors. We give you a non-exclusive, non-transferable right to use the Service during the term of these Terms for your internal business purposes. You may not copy, resell, reverse engineer or build a competing service from it, except as the law allows. If you send us feedback or suggestions, we may use them without obligation to you.

10. Confidentiality

Each party will keep the other's non-public information confidential and use it only for the purposes of these Terms, except where disclosure is required by law or a court. Customer Data is treated as the Customer's confidential information.

11. Availability and support

We work to keep Aajar available and secure, but we do not promise that it will be uninterrupted or error-free. Planned maintenance and events outside our control (including failures of internet, hosting, power, email or payment providers) may interrupt it. We give support through the Help & contact form; unless we agree a service level with you in writing, there is no guaranteed response time. Biometric attendance devices, networks and phones are the Customer's own equipment; we are not responsible for how they behave.

12. Suspension, termination and deleting data

  • By you. You can stop using Aajar at any time. To close the organization and delete its data, ask us through the Help form from the Owner's email address.
  • By us. We may suspend or end access if the Customer does not pay, breaches these Terms or the Acceptable Use Policy, puts the Service or other customers at risk, or if the law requires it. Where it is reasonable we will give notice and a chance to fix the problem first.
  • Your data afterwards. After a plan ends, or when access is suspended for non-payment, we keep the organization's data for a reasonable period so you can come back and pay or export it. When an organization is deleted, its Customer Data and its users' logins are permanently removed. We keep only invoices and payment records for as long as tax and accounting laws require (typically six to eight years) and any records we must keep to resolve a dispute or meet a legal duty.
  • Sections that by their nature should survive termination (such as payment, confidentiality, liability and governing law) do.

13. Warranties and disclaimer

We promise to provide the Service with reasonable skill and care. Apart from that, and to the extent the law allows, the Service is provided “as is” and “as available”, and we do not give any other warranty, including that it will meet every requirement of your business or that every payroll, attendance or tax figure it shows is correct for your situation.

14. Limit of liability

To the extent the law allows:

  • we are not liable for indirect or consequential loss, or for loss of profit, goodwill, business or data that could not reasonably have been foreseen;
  • our total liability to the Customer for all claims connected with the Service in any 12-month period is limited to the fees the Customer paid us for the Service in the 12 months before the event that gave rise to the claim (or ₹1,000 if the Customer has paid nothing).

Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud or wilful misconduct.

15. Indemnity

The Customer will defend and compensate us against third-party claims, and the reasonable costs of dealing with them, that arise from its Customer Data, from its use of Aajar in breach of these Terms or the law, or from the way it treats its own employees (for example, a claim that it monitored them without the notice the law requires).

16. Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page with a new “Last updated” date and, for a material change, email the Owner at least 15 days before it takes effect. If you keep using Aajar after the change takes effect, you accept it. If you do not agree, you may cancel before then.

17. Governing law and disputes

These Terms are governed by the laws of India. We would like to settle any dispute first by talking: write to us through the Grievance Redressal process and we will try to resolve it within 30 days. If it is not resolved, the courts in Tamil Nadu, India have exclusive jurisdiction.

18. General

  • Whole agreement. These Terms and the documents listed in section 1 are the whole agreement about the Service and replace earlier discussions about it.
  • If a part is invalid, the rest continues to apply.
  • No waiver. Not enforcing a right at once does not mean we give it up.
  • Assignment. You may not transfer your rights under these Terms without our written consent. We may transfer ours as part of a business reorganisation or sale.
  • Notices. We may give notice by email to the Owner or by a message inside the app. You can write to us through the Help form.
  • Independent parties. Nothing here makes either of us the agent, partner or employer of the other.

19. Contact

Questions about these Terms: use the Help & contact form and mention “Terms” in the description. Complaints are handled by the Grievance Officer at Score Xcreen; see Grievance Redressal.
